Your offer has been accepted. Exciting! But what happens now?

Daniel breaks the NSW home buying process into seven main stages:

Finance pre-approval → Research → Offer & Acceptance → Contract Negotiation & Advice → Exchange → Settlement → Collect Your Keys

Once your offer is accepted, get the contract to your conveyancer as soon as possible.

And here’s something first home buyers don’t always realise: having your offer accepted isn’t the same as exchanging contracts.

An accepted offer doesn’t automatically mean you’re legally obliged to sign the contract. This is an important window to get professional advice and make sure you’re comfortable with what you’re buying and signing.


What Should You Check Before Buying a House or Unit?

No one wants to collect the keys to their beautiful new home and then discover a very expensive surprise.

Depending on the property, Daniel recommends considering a building and pest report. If you’re buying an apartment, townhouse or other strata property, you’ll also want to consider a strata report.

And this isn’t necessarily a document you need to decipher alone.

When Do You Pay the Deposit When Buying a House in NSW?

This is one of the questions Daniel gets asked most often.

The deposit forms part of the process leading to exchange of contracts and is usually paid into the selling agent’s trust account.

Where a cooling-off period applies, the balance of the deposit needs to be paid before that period expires.

Daniel also recommends understanding where your finance is up to before becoming unconditionally bound by the contract.

Every purchase is different though. Don’t assume the timing for someone else’s house purchase applies to yours. Check exactly when your deposit is due with your conveyancer.


When Does the Cooling-Off Period Start in NSW?

This is the other question Daniel tells us buyers ask him all the time.

Your cooling-off period starts following exchange of contracts.

For many residential property purchases in NSW, there is generally a five-business-day cooling-off period. There are important exceptions, including properties bought at auction or when a buyer waives the cooling-off period using a section 66W certificate.

That cooling-off period can give you valuable time to finalise things such as finance approval and relevant property reports.

Once the cooling-off period expires, or if you waive it, the contract becomes unconditional and you’re bound by it.

So if you’re confused about when your cooling-off period starts or finishes, this isn’t something we’d be asking Google or AI and hoping for the best. Get the answer for your particular contract from your conveyancer.

Buying at Auction in Wollongong? Get Your Contract Checked Before You Bid

Love the house. Auction day arrives. Adrenaline kicks in. You win!

Great – as long as you’ve done the important stuff before you put your hand up.

Daniel recommends getting the contract to your conveyancer before auction day. This gives them time to review it, complete relevant due diligence and negotiate any appropriate changes before you bid.

And there’s a very important difference when buying at auction:

There is no cooling-off period.

If you’re the successful bidder and the reserve has been met, you’re legally obliged to proceed with the purchase.

Definitely not the time to think, “I’ll get someone to check the contract tomorrow.”

What Happens at Property Settlement?

Settlement day – finally!

This is when the property purchase is completed and ownership transfers to you.
